1. Acceptance of Terms

By downloading, installing, or using Opnrs ("the App"), you agree to these Terms and Conditions. If you do not agree to all of these Terms, you must discontinue using the App immediately.

2. App Overview

• Name: Opnrs
• Purpose: A mobile platform offering categorized, depth-based conversation starters (fun, casual, and deep) for various settings such as professional networking, personal discussions, and casual interactions.

3. Subscription Plans and Pricing

iOS Pricing (Effective August 2025):

• Monthly Subscription: $7.99 USD per month
• Annual Subscription: $34.99 USD per year
• Lifetime Purchase: $49.99 USD (one-time payment)

Payment Processing:

• All payments are processed through the Apple App Store or Google Play Store
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period

Platform Limitations:

• Cross-Platform Purchases: Due to App Store and Google Play Store policies, purchases made on one platform (iOS/Android) do not transfer to other platforms
• No Account System: The App operates offline-first with no email registration, so purchases are tied to your device's App Store account
• Multiple Devices: To use the App on multiple platforms, separate purchases are required for each platform

Refund Policy:

• No Refunds: All purchases are final and non-refundable
• Platform Policies: Refund requests must be made directly through the App Store or Google Play Store according to their respective policies
• Technical Issues: If you experience technical problems preventing app usage, contact support@opnrs.app for assistance

4. Data and Privacy

• Usage Data: We collect usage data through third-party analytics services (Amplitude). This may include click data, session durations, and general activity metrics.
• No Personal Information: We do not collect or store personal information (e.g., names, email addresses).
• Data Usage: Any data collected is used solely to improve the user experience and app functionality. We do not sell or share this data for marketing or commercial purposes.
• Offline Operation: The App is designed to work primarily offline, with most data stored locally on your device.

5. Content and Intellectual Property

Content Ownership:

• Conversation Starters: The conversation questions, prompts, and topics in the App are proprietary content created through a combination of human curation and AI assistance
• Design and Branding: The App's layout, user interface, visuals, branding, fonts, colors, and overall design are the exclusive property of the developer

Prohibited Uses:

You agree NOT to:

1. Commercial Copying: Copy, reproduce, distribute, or republish any portion of the App's questions, prompts, or content for commercial purposes, including but not limited to:

   • Creating competing apps or products
   • Selling or licensing the content to third parties
   • Using content for commercial training of AI systems
   • Bulk extraction for commercial databases or services

2. AI Training and Data Mining: Use automated systems, bots, scrapers, or other technological means to extract, copy, or harvest the App's content for machine learning, AI training, or data mining purposes

3. Reverse Engineering: Attempt to reverse-engineer, decompile, disassemble, or exploit any part of the App's functionality, security, or proprietary algorithms

4. Brand Misuse: Replicate, copy, or distribute the App's design, branding, or user interface in a way that could mislead others or infringe on intellectual property rights

Permitted Personal Use:

• You may use individual questions and prompts for personal, non-commercial conversations
• You may share individual questions informally with friends and family
• Educational use in non-commercial settings is permitted with proper attribution

6. What Your Subscription Includes

Current Features (Included in All Paid Plans):

• Unlimited access to all conversation starter categories
• All available conversation depths (fun, casual, deep)
• Access to all current font and color customization options
• Offline functionality
• No advertisements

Future Updates Included:

• New Conversation Content: Regular additions of new questions, topics, and categories
• Design Updates: New fonts, colors, and visual customization options
• App Improvements: Bug fixes, performance enhancements, and usability improvements

Future Features Not Included:

• AI-Powered Features: Any future AI functionality (such as personalized question generation) may require separate subscription plans
• Major Feature Additions: Significant new capabilities beyond conversation starters may require additional purchases
• Third-Party Integrations: Future integrations with external services may have separate pricing

7. Usage Restrictions

You agree NOT to:

1. Use the App for illegal activities, including but not limited to promoting hate speech, harassment, or defamation
2. Use the content to generate revenue through any commercial means without explicit written consent
3. Attempt to circumvent, disable, or interfere with security-related features of the App
4. Violate any applicable local, state, national, or international law or regulation

8. Limitation of Liability

• As-Is Basis: The App is provided "as is" without warranties of any kind, either express or implied
• No Warranty: We do not warrant that the App will be uninterrupted, error-free, or completely secure
• Limited Liability: In no event shall the developer be held liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the App, except as required by applicable law
• Maximum Liability: Our total liability to you for all claims shall not exceed the amount you paid for the App in the 12 months preceding the claim

9. Dispute Resolution and Arbitration

• Arbitration: Any dispute arising out of or relating to these Terms will be resolved through binding arbitration, rather than in court, except where prohibited by law
• Jurisdiction: Such arbitration shall take place in Phoenix, Arizona, or another location agreed upon by both parties
• No Class Actions: You agree to resolve disputes on an individual basis and waive any right to participate in a class-action lawsuit, except where prohibited by law

10. Geographic Availability

The App and its paid features are available in all countries where the Apple App Store and Google Play Store operate, subject to local laws and regulations.

11. Modifications

• Terms Updates: We reserve the right to modify or replace these Terms and Conditions at any time
• Notification: Material changes will be communicated through the App, our website, or other reasonable means
• Continued Use: Continued use of the App after any changes signifies acceptance of the new Terms
• Subscription Changes: Existing subscribers will be notified of any changes to subscription terms with at least 30 days notice

12. Termination

• User Termination: You may stop using the App at any time by deleting it from your device
• Developer Rights: We reserve the right to disable or limit your access if you seriously violate these Terms, especially concerning unauthorized copying or commercial misuse of content
• Effect of Termination: Upon termination, your right to use the App ceases immediately, but these Terms shall remain in effect regarding any prior use
